Senior federal counsel Datuk Kamaludin Mohd Said, representing the Attorney-General's chambers in the matter, told the court that it can refer the matter to the federal court under Section 84 of the Courts Of Judicature Act. Nizar's lead counsel Sulaiman Abdullah disagreed with the transfer and asked Judge Lau Bee Lan to grant leave for the application instead. Lau is now presiding over the suit after Judicial Commissioner Ariff Yusof recused himself on Feb 23 in the interest of public perception that justice was seen to be done given that he had previously acted as counsel for PAS, PKR and Barisan Nasional (BN) on election petitions. Nizar filed the suit at the Kuala Lumpur High Court on Feb 13 against new Menteri Besar Datuk Dr Zambry Abdul Kadir seeking a judicial review and for the courts to declare Nizar the valid menteri besar of Perak. Nizar, represented by an eight-member legal team, is also seeking an injuction to prevent Zambry or his agents from continuing his roles as menteri besar as well as for an interpretation of the Perak state constitution on the legality of his removal from office. In Perak this afternoon, the Ipoh High Court will hear two suits against Speaker V Sivakumar. The Perak MB is seeking a court declaration that Sivakumar’s suspension of Zambry and his six state executive council (exco) members was unconstitutional. Zambry and the six exco members also want the court to declare that they have the right to attend and participate in state assembly proceedings and carry out their duties. The second suit against Sivakumar was filed by three independents who had resigned from their parties, pledging support to BN taking over the Perak state government. The three are asking the courts to decide on the status on their undated resignation letters which Sivakumar had used to declare their seats vacant.
