Wong Nai Chee to decide next move, says Youth chief

KUALA LUMPUR: The MCA faction aligned to vice-president Datuk Seri Liow Tiong Lai will wait for EGM requisitionist Wong Nai Chee to decide on its next move following party secretary-general Datuk Wong Foon Meng's rejection of the EGM request.

Youth chief Datuk Dr Wee Ka Siong said he was "disappointed" at the rejection of the Oct 29 requisition but would leave it to Wong Nai Chee to choose the best way forward for the faction.

Nonetheless, Wee contended that the requisition should have been treated fairly.

"The question of whether the resolutions are unconstitutional or not... I think everyone has his own interpretation on the resolutions. However, if the resolutions are formulated based on the party constitution as claimed by Nai Chee, the EGM must be called,"said Wee when met at the parliament lobby today.

"The purpose of the EGM is not to keep or eliminate someone's position in the party but to get a fresh mandate from the central delegates," he said.

He added that it was difficult to call for an EGM without the support of the party headquarters as it would cost about RM1 million to hold one.

"It will become a financial obstacle for us (to hold an EGM). So, it is now up to the central committee members, but it is clear that we have to empower the central delegates to make a decision," he said.

The sixteen central committee  members who requisitioned for the EGM included vice-president Tan Kok Hong, Wee and Wanita chief Datin Paduka Chew Mei Fun.

Asked whether it was possible to get a third of the central delegates to request for an EGM or if it was best to settle the issue in court, Wee said it would be up to Wong Nai Chee to decide.

He also said the 16 signatories had yet to meet up to decide on the next course of action.

Foon Meng in rejecting the requisition for an EGM said the general assembly (GA) could not force or direct fresh elections unless the requisition came within the ambit of Article 35, Article 41 or Article 167.

Article 35 provides that the GA may dismiss any party official if approved by at least two-thirds of the central delegates to the GA present and voting at the meeting of the GA.

Article 41 states that if two-thirds or more of the elected CC members shall at any time cease to be members of the CC, the remaining members shall within three days elect one of themselves to convene at the shortest possible time an EGM to elect a new committee.

And Article 167 provides that party elections will be held once every three years.

On the proposed second resolution to nullify any appointment or termination by the president after the Oct 10 EGM, he said it had run counter to the powers conferred to the president to appoint and to terminate any appointee pursuant to the party constitution.
