Judge Datuk Azhar Mohamed, brought from Kuala Lumpur to Ipoh High Court for the case, fixed the date after meeting the counsels in chambers today. Sivakumar filed the suit at the Ipoh High Court on May 15 in relation to Ganesan's orders for police officers to remove Sivakumar from the assembly during the chaotic May 7 Perak state legislative assembly. Sivakumar's counsel Leong Cheok Keng, when contacted, said Ganesan's application to postpone the hearing was a "valid request" as Ganesan only received the legal documents recently and needed time to file his affidavits in reply. Leong also said he objected to Ganesan's other applications to strike out the suit and for Sivakumar to deposit RM100,000 as security for costs. Both Sivakumar and Ganesan were not present in court today. In the civil suit, Sivakumar also sought to take Ganesan to task for assault, battery and false imprisonment. After his removal, Sivakumar was placed in a room near the assembly until the sitting was adjourned indefinitely. Sivakumar, who is Tronoh assemblyman, also was seeking an injunction to prevent Ganesan from stopping the former from performing the duties of a Speaker. Sivakumar maintains that he was still the legitimate Perak Speaker. Ganesan was elected on May 7 after Barisan Nasional representatives passed a motion tabled before deputy Speaker and independent Jelapang assemblywoman Hee Yit Foong. On the outset of the previous sitting, Perak Menteri Besar Datuk Seri Dr Zambry Abdul Kadir’s attempt to table a motion to remove Sivakumar had been rejected by the latter.
