Proceedings, initially scheduled for today, were postponed at the request of the accused’s lead counsel Sulaiman Abdullah on grounds that Anwar and his counsel R Sivarasa had to attend parliamentary sittings. Anwar is member of parliament (MP) for Permatang Pauh while Sivarasa is Subang MP. Anwar is appealing the Kuala Lumpur High Court decision on March 5 in which Judge Datuk Mohamad Zabidin Mohd Diah allowed the sodomy trial to be transferred from the Sessions Court to the High Court. In granting the prosecution's request for the transfer, Mohamad Zabidin over ruled Sessions Court Judge SM Komathy Suppiah's Nov 7, 2008 decision to hear Anwar's sodomy case after dismissing a certificate of transfer signed by the Attorney-General (AG) as invalid. Anwar is charged with sodomising his former aide Mohd Saiful Bukhari Azlan in Bukit Damansara on June 26 last year. The charge, under Section 377B of the Penal Code, carries a maximum penalty of 20 years' imprisonment. Meanwhile, the Kuala Lumpur High Court will hear on Wednesday Anwar's application to compel prosecution to furnish him with evidence and statements ahead of proceedings on July 8. The High Court will hear the sodomy trial proper pending the outcome of Anwar's application to strike out the sodomy charges, both scheduled before the High Court on July 8.
