PETALING JAYA: Perak Menteri Besar Datuk Dr Zambry Abdul Kadir, via the state legislative assembly secretary, has issued a notice this morning calling for the Perak legislative assembly to convene on May 7, said Teja assemblyman Chang Lih Kang.

Chang told The Edge Financial Daily that he had received a call this morning from the state secretary's office informing him that a notice of assembly will be sent.

While he had not received the notice, Chang said he was told that the assembly would convene over two days from May 7 to May 8.

According to Chang, either the menteri besar or the Speaker can call for the assembly meeting and the state legislative assembly's secretary would send out official notices.

The Perak state legislative assembly has until May 13, six months from its last meeting, to convene, failing which it would be considered dissolved.

The Federal Court in the last two weeks had made two landmark rulings, removing major blockages to the deadlocked Perak state legislative assembly.

The apex court yesterday removed the suspension of Zambry and the six executive councillors by Sivakumar after it found that Sivakumar had acted beyond his powers.

The six exco members are Zainol Fadzi Paharuddin (Sungai Manik), Datuk Ramly Zahari (Manong), Hamidah Osman (Sungai Rapat), Datuk Saarani Mohamad (Kota Tampan), Mohd Zahir Abdul Khalid (Kamunting) and Dr Mah Hang Soon (Chenderiang).

Sivakumar had ordered Zambry and the six exco members to be suspended for 18 months and 12 months respectively for contempt of the house after the seven failed to answer to a Special Privileges Committee.

The committee, chaired by Sivakumar, was established to investigate a complaint by Canning assemblyman Wong Kah Woh that the seven who had accepted appointments deemed unconstitutional.

However, DAP Perak chief Datuk Ngeh Koo Ham maintained that the Federal Court's decision on Zambry and the six exco members were merely declarations, not orders compelling Sivakumar to lift the suspensions.

The same five-member bench at the Federal Court, led by Court of Appeal President Tan Sri Alauddin Mohd Sheriff, last Thursday also ruled that the three independent assemblymen who quit their respective parties can retain their seats.

The four other judges on the panel were Chief Judge of Malaya Datuk Arifin Zakaria and Federal Court Judges Datuk Seri Augustine Paul, Datuk Zulkefli Ahmad Makinudin and Datuk Nik Hashim Nik Abdul Rahman.

The three former Pakatan Rakyat (PR) assemblymen — Jamaluddin Mohd Radzi (Behrang), Mohd Osman Mohd Jailu (Changkat Jering) and Hee Yit Foong (Jelapang) — filed the suit challenging Sivakumar, who had used their undated resignation letters to declare the seats vacant.

In that decision, the apex court ruled that the Election Commission (EC) was the rightful entity to declare casual vacancies in seats and not the Speaker.

The trio's resignation resulted in a political deadlock as both Barisan Nasional and Pakatan Rakyat had 28 representatives each in the house, excluding the three.

Zambry was appointed menteri besar on Feb 6 after Perak ruler Sultan Azlan Shah deemed Zambry to command the majority support of the house after the three independents declared themselves friendly to BN.

Sultan Azlan Shah also ordered the then menteri besar Datuk Seri Mohammad Nizar Jamaluddin to tender his resignation, denying Nizar’s request to dissolve the assembly for fresh elections to resolve the deadlock in the assembly.

Just two days before the Perak state assembly meets again, the Kuala Lumpur High Court will on May 5 hear the suit brought by Nizar challenging the validity of Zambry as Perak menteri besar.

As to how the Perak assembly meeting will be played out, Chang quipped, "You'll just have to come and see. I'm sure there will be some pandemonium."
